Terms of Service

These Terms of Service ("Terms") govern your access to and use of Photolaria ("Photolaria", "we", "us"), the AI photo platform available at photolaria.com – including its photo editors, photo generators, studios, and related tools (together, the "Service"). By using any part of the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Photolaria
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use Photolaria. The service is not directed at minors, and we do not knowingly allow accounts for anyone under 18.
2. Accounts and login
- Paid accounts are created through a purchase. There is no separate signup form.
- Login is passwordless: we email a one-time code to your account email address. You are responsible for keeping access to that email address secure.
- Free usage is available without a paid account. One free account per person – creating multiple accounts or resetting guest sessions to collect extra free credits is not allowed and may lead to suspension or blocking, including by IP address.
- You are responsible for all activity that happens under your account.
3. Fees, subscriptions, and credits
- All prices are listed in US dollars (USD). Payments are processed by Stripe; we never see or store your card number.
- Subscriptions renew automatically each billing cycle until you cancel. You can cancel anytime from the customer portal in your profile; your plan stays active until the end of the paid period and you will not be charged again.
- Creating photos – whether editing an existing photo or generating a new one – is priced in credits:
- Subscription credits are granted each billing cycle and reset to your plan's amount at every renewal. Unused subscription credits do not carry over.
- Purchased credits (credit packs) never expire and remain spendable even after your subscription ends. New credit packs can only be purchased while you have an active subscription.
- Free daily credits are a small daily allowance that resets each day and does not accumulate. They are guaranteed only for accounts, because credits are tied to your account. In guest sessions (use without an account) free daily credits are a courtesy, not a guarantee: to prevent abuse – such as resetting sessions to collect unlimited free credits – we may limit, suspend, or block free creation for individual sessions, IP addresses, or IP ranges. The free daily allowance is a promotional courtesy, not a purchased entitlement: we may reduce, suspend, or discontinue it entirely at any time and for any reason (including changes in our own costs), for guests and accounts alike. For guest sessions such changes may take effect immediately; for paid subscribers any reduction or removal applies from the next renewal (with the notice in section 16) and never to a billing period you have already paid for. No change ever affects credits already granted, or your paid-for subscription or purchased credits.
- Credit costs per photo depend on the model used and are shown in the editor before you generate.
- Changing your plan mid-cycle. Upgrades take effect immediately: Stripe charges a prorated amount for the remainder of the current cycle, and subscription credits are granted in proportion to that charge – not the full new monthly allowance, which applies from your next renewal. Downgrades take effect at the end of your current billing cycle: you keep your current plan and its credits until then, with no mid-cycle charge, and at your next renewal you move to the new plan and your subscription credits reset to its amount. Plan changes affect only subscription credits – purchased and free daily credits are unaffected.
- We may change prices or plan contents; changes apply from your next renewal, never retroactively to a period you have already paid for.
4. Refunds and cancellation
Your first subscription payment is covered by a 14-day money-back guarantee (conditions apply). A granted refund closes your account. See our Refund Policy for the full details, including renewals and credit packs.
5. Your content and ownership
- The photos you create with Photolaria are yours – edited or generated. We claim no ownership of your uploaded or created photos, and we pass on to you all rights, title, and interest that we hold or receive in photos generated for you. What "ownership" means for AI-generated images has legal limits – see section 6 (AI-generated content) below.
- Usage rights depend on your plan: free usage (without a paid subscription) is for personal, non-commercial use. All paid plans include commercial usage rights: we place no restriction on your commercial use of the photos you generate. Whether a particular use is otherwise lawful – third-party rights, disclosure rules – is your responsibility, and your use of generated photos, commercial or not, is at your own risk (see sections 6 and 13).
- You grant Photolaria a limited, non-exclusive license to host, store, process, and display your uploaded and generated content solely to operate and provide the service to you (for example: running generation jobs, showing your gallery, keeping backups). This license ends when you delete the content or your account, except where short-lived backup copies persist briefly before being purged.
- Your galleries are private by default on every plan. We do not publish your photos.
- Commercial use of another person's likeness may require their permission under publicity and personality rights laws in your jurisdiction – that permission is between you and them, and it is your responsibility to obtain it.
- You are responsible for the content you upload. You must hold the necessary rights and consents for every photo you upload – see section 7 below.
6. AI-generated content
Photolaria creates photos using third-party AI models. That comes with a few realities you should understand before relying on a generated photo:
- Outputs may not be unique. AI models can produce the same or similar images for other users, on Photolaria or elsewhere. We cannot promise that a photo you generate will be one of a kind.
- Copyright in AI output is unsettled. In many jurisdictions, images generated primarily by AI may not qualify for copyright protection at all. When we say your created photos are "yours" (section 5), we mean that as between you and Photolaria, everything we have in them is yours. We do not warrant that this amounts to an enforceable copyright or any other registrable right.
- Third-party rights. A generated photo may unintentionally resemble a real person, a trademark, a copyrighted work, or other protected material. We do not check or clear generated photos against third-party rights, and we make no warranty of non-infringement for them. Before using a photo – especially commercially – clearing such rights is your responsibility.
- Upstream model policies apply. The AI models behind Photolaria are built and operated by third parties (currently models from Google and OpenAI, accessed through our infrastructure providers). Your use of the service and of generated photos must also comply with those model providers' generative-AI usage policies, and the rights we pass to you in section 5 are subject to the terms those providers grant down the chain to us.
- Provenance marks. Generated photos may carry invisible watermarks or embedded metadata (such as Google's SynthID) identifying them as AI-generated. You may not remove, alter, or obscure these marks. Laws where you live or publish (for example, the EU AI Act) may require you to disclose that an image is AI-generated or manipulated; complying with those disclosure rules is your responsibility.
7. Photos of people – consent
Photolaria lets you upload photos and generate new images of the person in them with AI. That power comes with one core rule: only with consent.
- Yourself – always allowed.
- Another adult – only with their explicit consent. They must know their photos are being used for AI image generation and agree to the kinds of images you intend to generate. Get it in writing; if a dispute arises, you will need to evidence it.
- Minors – never. You may not upload photos of anyone under 18 under any circumstances, including your own children. See the Acceptable Use Policy.
You are responsible for holding the rights to every photo you upload – both the consent of the person depicted and the rights to the photo itself (you took it, or the photographer allows this use). Even with a subject's consent, you may not generate nude, semi-nude, or sexually explicit imagery of any real person, and you may not create deceptive deepfakes – these limits are absolute, see the Acceptable Use Policy.

8. Copyright takedowns
If you believe content on Photolaria infringes your copyright, send a takedown notice to [email protected] including: identification of the copyrighted work, the infringing material's location, your contact details, a good-faith statement that the use is unauthorized, and a statement, under penalty of perjury, that you are the rights holder or authorized to act for them. We remove infringing material and terminate repeat infringers' accounts.
9. Acceptable use
Use of Photolaria is subject to our Acceptable Use Policy, which is part of these Terms. In short: no sexual or intimate imagery of real people, no content involving minors, no deepfakes or impersonation, no unlawful use. Violations can lead to immediate suspension without refund.
10. Termination
- You may stop using Photolaria and delete your account at any time from your profile.
- We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy. Where the violation is serious (for example, content involving minors), termination is immediate and may be reported to authorities.
- Sections of these Terms that by their nature should survive termination (ownership, AI-generated content, disclaimers, limitation of liability, indemnification, governing law) survive it.
11. Service changes and availability
Photolaria is under active development. We may add, change, or remove features. We aim for high availability but do not guarantee uninterrupted, error-free operation.
12. Disclaimer
Photolaria is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated output is probabilistic: we do not guarantee that generated photos will be accurate, appropriate for your purpose, or free of artifacts, and we make no promises about specific results. In particular, we do not warrant that the photos you create are unique, protectable by copyright, or free of third-party rights – including copyright, trademark, and the publicity or personality rights of people a generated image may resemble. See section 6.
13. Limitation of liability
To the maximum extent permitted by law, Photolaria is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data. Our total liability for any claim related to the service is capped at the amount you paid us in the 12 months before the claim arose.
14. Indemnification
If a third party brings a claim against Photolaria arising from (a) content you upload, (b) your use of the photos you create – including commercial use, (c) your breach of these Terms or the Acceptable Use Policy, or (d) your violation of another person's rights – including consent, privacy, publicity, or intellectual-property rights – you agree to defend us against that claim and to cover the resulting damages, costs, and reasonable legal fees. We will notify you promptly of any such claim, and we may choose to take over its defense at our own expense.
15. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules. If something goes wrong, talk to us first – email [email protected]; most issues are resolved quickly and informally. Any dispute we cannot resolve informally will be brought exclusively in the courts having jurisdiction over our registered seat in Poland, and you and we each consent to their jurisdiction. If you are a consumer, nothing in this section takes away mandatory consumer protections of your home country or any right you have to bring claims in your local courts.
16. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Material changes take effect no sooner than 14 days after posting, except changes required by law, which may take effect immediately. Continued use of Photolaria after a change means you accept the updated Terms.
17. Miscellaneous
Some tools on Photolaria may carry supplemental terms shown where the tool is offered; where they conflict with these Terms, the supplemental terms control for that tool. If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, Acceptable Use Policy, and Refund Policy, are the entire agreement between you and Photolaria about the service.
